Failure to Provide Reasonable Breaks or Place to Pump

The Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act) requires employers to provide reasonable break time to express breast milk for one year after the child’s birth. Employees are also entitled to a designated area at work, other than a bathroom, that is shielded from view and free from intrusion by coworkers and the public for pumping breast milk.

 

If your employer is not providing you with an adequate space to pump, you must notify them and give them 10 days to provide a suitable place for you to pump. If the employer does not provide you with a suitable place to express milk, you can file a lawsuit.

 

A lawsuit can be filed right away:

  • If your employer fails to provide you with reasonable breaks to pump.
  • If the employer has indicated it has no intention of providing you with private space for pumping.
  • If you are fired for requesting reasonable breaks to pump or for requesting a suitable place to pump.
