Worker’s Compensation Retaliation

South Carolina law protects employees from retaliation for filing workers’ compensation claims. No employer may discharge or demote any employee because the employee has brought a proceeding under the South Carolina Workers’ Compensation Law, or has testified or is about to testify in any such proceeding. You must put your employer on notice that you intend to file a workers’ compensation claim; merely seeking or receiving medical treatment is not sufficient.
